These Terms of Use (“Terms”) govern your access to and use of SmartWhisker, a mobile and web-based enrichment platform for cat guardians. By accessing or using SmartWhisker, you agree to comply with these Terms.

1. Overview
SmartWhisker provides non-diagnostic, educational features including personalized enrichment suggestions, progress tracking, and daily engagement tools for cat care.

2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use SmartWhisker. If you are under 18, you must have permission from a parent or legal guardian.

3. Account Registration
Some features may require an account. You agree to provide accurate information and are responsible for maintaining your account’s security.

4. Subscriptions & Payment
SmartWhisker offers paid subscriptions through app stores. Free trials may be available. Your subscription auto-renews unless canceled at least 24 hours before the current billing period ends. Subscriptions must be managed via your App Store or Google Play account settings. We do not offer partial refunds for unused time.

5. AI Personalization
The Enrichment Assistant provides recommendations based on AI using your cat’s profile, activity history, and selected traits. These are for informational use only and are not a substitute for professional veterinary advice.

6. Acceptable Use
You agree not to:
• Use SmartWhisker for commercial or unlawful purposes
• Copy, distribute, or reverse-engineer any part of the app or content
• Upload harmful or misleading data

7. Content and Intellectual Property
All content, including names, illustrations, interfaces, and text, is owned by SmartWhisker. You may not reuse or reproduce it without written consent.

8. Third-Party Services
SmartWhisker may rely on third-party services (e.g., Firebase, Mixpanel, Meta/Facebook SDK) for analytics, hosting, advertising, or performance. These services may collect limited technical or engagement data to help us improve functionality, understand how users find the app, and measure the effectiveness of our marketing. These services are governed by their own terms and privacy policies.

9. Privacy and Data Protection
Use of the app is subject to our Privacy Policy. We comply with relevant data protection laws such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

10. Disclaimer
SmartWhisker is not a veterinary service and does not offer health or treatment advice. Activities and insights are provided for enrichment and behavioral support only.

11. Limitation of Liability
SmartWhisker is not liable for any direct, indirect, incidental, or consequential damages resulting from use of the app or its content. Use is at your own discretion and risk.

12. Termination
We reserve the right to suspend or terminate access if you violate these Terms or misuse the Services.

13. Changes to Terms
We may update these Terms from time to time. We will notify users of significant changes via in-app notice or email. Continued use constitutes agreement to updated Terms.
